1. Scope
These General Terms and Conditions govern the contractual relationship between CuraCap GmbH (hereinafter "Provider") and the customer (hereinafter "Customer") in the version applicable at the time of the order.
A consumer in the meaning of these Terms is any natural person who concludes a legal transaction for purposes that can predominantly be attributed neither to their commercial nor to their independent professional activity (§ 13 German Civil Code). An entrepreneur is any natural or legal person or partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their commercial or independent professional activity (§ 14 German Civil Code).
Customer's deviating terms shall not apply unless the Provider expressly agrees to their validity in writing.
2. Conclusion of contract
The presentation of products in the online shop does not constitute a legally binding offer but an invitation to place an order.
By clicking the "Buy now" / "Order with payment" button, the Customer makes a binding offer to purchase the goods in the shopping cart.
The Provider confirms receipt of the order without delay by email. This order receipt confirmation does not yet constitute acceptance of the contract. The contract is concluded upon shipment of the goods or by separate order confirmation by email.
If the Provider cannot accept the order, the Customer will be informed without delay and any payments already made will be refunded.
3. Contract language, contract storage
Contract languages are German and English. In case of conflicts, the German version prevails.
The contract text is stored by the Provider and sent to the Customer with the order confirmation in text form (email). The Customer also receives an invoice in PDF format by email.
4. Delivery
Delivery is made from Germany to all EU member states. Shipping logistics are handled via Amazon Multi-Channel Fulfillment. Shipments are sent in neutral packaging without Amazon branding.
Expected delivery time is 1–3 business days within the EU after order receipt. Should a product be temporarily unavailable, the Customer will be informed without delay.
Customers in Switzerland are kindly asked to order via our Swiss shop at https://curacap.ch.
5. Prices and shipping costs
All prices are in euros and include the applicable statutory value added tax.
Within the EU, no shipping costs are charged. Shipping to third countries does not apply, as we ship within the EU only.
The Provider reserves the right to adjust prices at any time. The prices stated in the online shop at the time of the order apply to that order.
6. Payment
Payment is processed via Stripe Payments Europe Ltd. (Ireland). Available payment methods: credit card (Visa, Mastercard, American Express), SEPA direct debit, Klarna, Apple Pay, Google Pay.
The purchase price is due for payment upon conclusion of the contract.
The Provider reserves the right to exclude individual payment methods without giving reasons.
7. Retention of title
The delivered goods remain the property of the Provider until the purchase price has been paid in full.
8. Right of withdrawal
Consumers have a statutory right of withdrawal. Details are set out in our separate withdrawal notice at https://curacap.biz/en/right-of-withdrawal.
9. Warranty (statutory)
Statutory warranty provisions apply (§§ 434 et seq. German Civil Code). The limitation period for warranty claims for new goods is two years from receipt of the goods.
In case of defects, customers are kindly asked to contact info@curacap.biz. We process defect notifications within 14 days.
10. Liability
The Provider is liable without limitation for damages arising from injury to life, body or health resulting from a negligent or intentional breach of duty, and for other damages resulting from an intentional or grossly negligent breach of duty.
In the case of slightly negligent breach of essential contractual obligations (cardinal obligations), liability is limited to the foreseeable damage typical of the contract. Any further liability of the Provider is excluded.
The above limitations of liability do not apply to claims under the German Product Liability Act.
11. Online dispute resolution
The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr
We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
12. Final provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as the protection granted by mandatory provisions of the law of the country of the consumer's habitual residence is not withdrawn.
Should individual provisions of these Terms be invalid, the validity of the remaining provisions shall not be affected.
